Please read these Terms of Service carefully. By using this site and any MDDG web site, you are explicitly acknowledging, agreeing to be bound by, and assenting to these Terms of Service. If you do not agree with these terms, please discontinue your use of this web site. My DnD Game Limited and any subsidiary, parent, or sister company thereto ("MDDG"), reserve the right, in their sole discretion, to modify, alter, or otherwise update these Terms of Service at any time and by your use of the web site, you acknowledge and agree to be bound by such modifications, alterations, or updates.

All materials on this site, including but not limited to images, artwork, text, audio clips, and video clips, are, unless otherwise stated, owned and controlled by MDDG and may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way. Modification of the materials or use of the materials for any purpose is a violation of MDDG's legal rights. For purposes of these terms, the use of any such material on any other web site or networked computer environment is prohibited unless explicitly stated otherwise.

LINKED SITES

MDDG provides links to other sites on the Internet and World Wide Web. As MDDG has no control over these sites, it cannot be held responsible for the availability of such external sites nor is it responsible or liable for any content, advertising, products, or other materials on or available from such sites. Links to these sites are provided for your convenience only, and you access them at your own risk. In addition, MDDG is not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available through any such site.

SUBMISSIONS

Any notes, e-mails, online messages or bulletin board postings, ideas, suggestions, concepts, designs, or other material submitted to any physical MDDG company address or to any web site owned or controlled by MDDG and/or to any e-mail addresses contained in or on those web sites ("MDDG Web Sites") will become the property of MDDG throughout the world and MDDG shall be entitled to use the material for any type of use forever, including in any media whether now known or hereafter devised. When you submit any material to any physical MDDG company address or any MDDG Web Sites, you agree, offer, warrant, and represent, both explicitly and tacitly (and MDDG accepts) that you are assigning all intellectual property rights in that material to MDDG and that MDDG has the right to use that material at any time entirely in its own discretion for whatsoever purpose including for commercial, promotional, and advertising purposes without any obligation (including any financial obligation) to you now or at any time in the future. You waive and relinquish any rights, including "moral rights," that may exist in any content to the furthest extent permissible by law and agree not to assert any rights over that content. We are afraid that in order to protect ourselves legally, this is the only way we can operate. If you are unhappy with this policy, then please do not post or send any material to MDDG.

MDDG is not responsible for any material posted on any of our forums. You agree not to use this site to:

  1. Publish, post, distribute, or otherwise disseminate content that is libellous, defamatory, that invades privacy, or is obscene, pornographic, abusive, harassing, or otherwise unlawful or objectionable or which infringes on any intellectual property or other rights of any entity or person;

THE MATERIALS ON THIS SITE ARE PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, MDDG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. MDDG DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE MATERIALS WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT MDDG'S WEB SITES OR THE SERVER THAT MAKES THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. MDDG DOES NOT WARRANT OR MAKE REPRESENTATIONS REGARDING THE USE OR RESULTS OF THE USE OF THE MATERIALS IN THIS SITE IN TERMS OF THEIR QUALITY, ADEQUACY, CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.

LIMITATION OF LIABILITY

You agree to indemnify MDDG for any and all claims, damages, losses, and causes of action arising out of your publication or transmission of non-approved material or your failure to comply with these Terms of Service. Under no circumstances including, but not limited to, negligence, shall MDDG be liable for any special or consequential damages that result from the use of, or inability to use, the materials on this site.

TERMINATION

You agree that MDDG, in its sole discretion, may terminate any account (or any part thereof) you may have with us or use of the web site and remove and discard all or any part of your account or any Submissions, for any reason whatsoever, in MDDG's sole discretion. MDDG may also in its sole discretion and at any time discontinue providing the mydndgame.com site, or any part thereof, with or without notice. You agree that any termination of your access to the site or any account you may have or portion thereof may be effected without prior notice, and you agree that MDDG shall not be liable to you or any third-party for any such termination.

JURISDICTION

This Agreement shall be governed in accordance with California law and the courts of California shall have jurisdiction to settle any disputes which may arise out of or in connection with this agreement. Notwithstanding this, MDDG shall be free to initiate proceedings in any other court of competent jurisdiction if it deems it appropriate to do so. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable in whole or in part, then that provision shall be deemed severed from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
